These Terms of Service were revised on December 1, 2015. Your continued use of the First Lady Permanente means you agree to these revised terms.
FIRST LADY PERMANENTE IS ONLY WILLING TO PROVIDE THE SERVICES TO YOU UPON THE CONDITION THAT YOU ACCEPT ALL THE TERMS CONTAINED IN THIS AGREEMENT. PLEASE READ THIS AGREEMENT CAREFULLY AS IT AFFECTS YOUR LEGAL RIGHTS AND REMEDIES.
1.0 FEES AND PAYMENT
A. Fees. In consideration of the Services, Customer will pay to First Lady Permanente all fees due according to the prices and terms listed on the website. All sales are final and First Lady Permanente offers no partial or full refunds of any kind on any purchase. First Lady Permanente expressly reserves the right to change or modify its prices and fees at any time, and such changes or modifications shall be posted online at this Site and effective immediately without need for further notice to you. If you have purchased Services for a period of months or years, changes or modifications in prices and fees shall be effective when the Services in question come up for renewal. First Lady Permanente may, at its sole option, extend payment terms to you. Should First Lady Permanente extend payment terms, you agree that your obligation to pay First Lady Permanente for the Services ordered begins on the date of purchase and does not end until paid in full, even if the Services are abandoned, suspended, terminated or transferred prior to such time.
B. Payment. Unless otherwise agreed to in writing by First Lady Permanente, all non-refundable payments are due upon signup, the Services will not begin until payment is received. Failure to dispute a charge within 5 days following such charge shall constitute Customer's agreement that all charges are valid and Customer agrees to waive any claims it may have had regarding such charge. All customer disputes are only accepted for review by email; customer must email dispute to email@example.com immediately. If a payment is returned or rejected by First Lady Permanente's bank, or incurs additional cost for First Lady Permanente (e.g., bank fees) for any reason, then Customer may be charged a service fee of $40 and be required to reimburse all such fees and cost incurred by First Lady Permanente, and Customer shall be immediately deemed to be in default of this Agreement. Accounts and all amounts permitted by law, whichever is greater, until fully paid. If Customer defaults, customer agrees to pay First Lady Permanente its reasonable expense, including attorney, in house legal expenses and collection agency fees, incurred in enforcing its rights. NOTE- SAME DAY PAYMENT IS NOT ACCEPTED UNLESS AGREED UPON BY THE ADMINISTRATOR OF FIRST LADY PERMANENTE.
C. Customer Responsibility. Customer is fully responsible to ensure he or she is signing up for the correct service. Customer understands that all fees paid for a service are non-refundable. Customer takes full responsibility to ensure he or she is prepared for a course by completing required pre-course work, pre-tests, and proper studying of course. If a student does not prepare for a course he or she is aware their chances of passing the course is at jeopardy.
D. Billing Policies. Unless otherwise agreed to in writing by First Lady Permanente, we offer billing via credit card, debit charge and cash only - no personal checks. All initial fees must be paid prior to service setup, and are non-refundable.
Note: All billing correspondence (invoices, notifications, etc.) is done via email. It is crucial that you maintain a current email address with us.
E. Taxes. All fees charged by First Lady Permanente for the Services are exclusive of all taxes, VAT and similar fees now in force or enacted in the future imposed on the transaction and/or the delivery of Services, all of which Customer will be responsible for and will pay in full, except for taxes based on First Lady Permanente's net income. If First Lady Permanente is required to pay directly any such taxes, Customer will, upon receipt of First Lady Permanente's invoice, promptly reimburse First Lady Permanente for any such taxes paid by First Lady Permanente.
F. Service Cancellation. Customers of First Lady Permanente understand that if they cancel a service they will not be refunded, unless the service was cancelled by First Lady Permanente. Customers that have an emergency and unable to attend a course must notify First Lady Permanente by emailing firstname.lastname@example.org with a doctor's note (e.g. indicating student was unable to attend course "date" due to sickness) in order to be transferred at no fee, otherwise a transfer fee applies to some approved classes.
G. Service Ownership Transfer. Customers that no longer need a course have the right to sell their spot to another person that is willing to take their spot in the course. First and Last name must be notified to email@example.com
H. Course Participant Books. Books are required to bring to all First Lady Permanente classes, students can bring in their own current edition or they can purchase for an additional fee. Sharing a book with another course participant is not allowed in the course. E-books are acceptable, however students will be given a book in replacement as we are a "No Cell Phone Campus" as our courses have trademark materials that cannot be copied or photographed in class.
I. No Cell Phone Policy. Cell phones are not allowed for classroom use. Due to the different course materials that are used in class, students are not allowed to copy by taking a photo with phone. Also, students that are proven to take pictures of such material will be fined and penalized a fee of $2,500.00 and will be terminated from taking any other courses at First Lady Permanente campuses.
J. Dress code. All customers of First Lady Permanente are required to dress in a professional manner, no low cut shirts, short shorts, slogan t-shirts, and any other sort of clothing that is unprofessional is acceptable. Student will be asked to attend a different course at a later time and to dress appropriately. As First Lady Permanente is a medical education center, nurse scrubs that are clean are appropriate to wear or seminar style clothes.
K. Drug Free Campus. Students that show visible signs of alcohol or illegal drugs will be terminated from attending or finishing a course at First Lady Permanente. Our campus is a "Drug Free Zone".
L. Reserve the Right to Refuse Service. First Lady Permanente has the right to refuse service to any customer at any time. No explanations required.
1.1 SCHOOL POLICIES AND DISCLOSURES
A. Quality Control Policy. To ensure quality control of the curriculum and professional teaching methods all classrooms are monitored for quality assurance. The board at First Lady Permanente review the recordings on a periodic basis. All students and teachers are responsible to maintain a professional environment in the classroom and on First Lady Permanente campuses.
B. Theft. First Lady Permanente is not responsible for any theft on campus or in the parking lot. Student and teachers are required to maintain their own personal property and ensure on their own that it will not be stolen or damaged.
C. No Smoking Campus. First Lady Permanente is a "NO SMOKING CAMPUS", student are not allowed to smoke within 50 feet from the buildings due to the buildings fire code requirements.
D. Cheating Policy. First Lady Permanente does allow cheating on tests or quizzes. A student that cheats will be given the option to take the test and or quizzes at a later time to ensure no cheating. If the student is caught a 2nd time cheating he or she will be dismissed from the class or program and will be given a "No Pass Grade".
2.0 ACCEPTANCE USE POLICY
A. Acceptance Use Policy. First Lady Permanente maintains on its Web site First Lady Permanente's then-current Acceptable Use Policy ("AUP"). Customer agrees to abide by the AUP. First Lady Permanente may modify its AUP at any time, and shall post the then-current AUP on First Lady Permanente's Web site, which will be effective upon posting.
Customer acknowledges that the Internet is not a secure or completely reliable system, and that the purpose of the Services is to allow end users easy access to Customer's Content. First Lady Permanente will take those precautions First Lady Permanente's web host ("VOLUSIONS") deems responsible in its sole discretion to secure Customer's information from attack, but Volusion makes no warrant that Customer's Content will be secure against attack of any form by end users or other third parties.
4.0 PCI GUIDELINES
First Lady Permanente website content is CISP certified under optimal security settings. Website content is backed by a SSL Certificate verifying that First Lady Permanente website is PCI Compliant. The SSL Certificate is a strong security protocol used on First Lady Permanente website to safeguard sensitive cardholder data over networks.
5.0 NO SOLICITATION
Customer agrees Customer will NOT approach any employees of First Lady Permanente and its affiliates with proposals to hire them as its own employees or contractors. If you were to hire any of First Lady Permanente employees, you agree to pay First Lady Permanente for each employee hired the greater amount of $75,000.00 for each employee hired.
6.0 CUSTOMER'S IDEMNIFICATION
Customers shall indemnify and hold harmless First Lady Permanente from and against any and all claims, demands, actions, cause of action, suits, proceedings, losses, damages, costs, and expenses, including reasonable attorney fees and fees attributable to in house legal personnel, arising from or relating to Customer's provision, or an end user's use, of Customer's Content, or any act, error, or omission of Customer in connection therewith, including but not limited to matters relating to incorrect, incomplete, or misleading information; libel; invasion of privacy; infringement of a copyright, trade name, trademark, service mark, or other intellectual property or other right; or violation of any applicable law.
7.0 DISCLAIMER OF WARRANTIES
CUSTOMER SPECIFICALLY ACKNOWLEDGES AND AGREES THAT YOUR USE OF THIS SITE AND THE SERVICES FOUND AT THIS SITE SHALL BE AT YOUR OWN RISK AND THAT THIS SITE AND THE SERVICES FOUND AT THIS SITE ARE PROVIDED "AS IS", "AS AVAILABLE" AND "WITH ALL FAULTS". FIRST LADY PERMANENTE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, STATUTORY, EXPRESS OF IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. FIRST LADY PERMANENTE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS MAKE NO REPRESENTATIONS OR WARRANTIES.
8.0 WEB SITE CONTENT
First Lady Permanente updates the website on a daily basis, some services are no longer available at times. If this is the case, a customer will be notified immediately and will be given a full refund. If there are errors on the website please report such errors to firstname.lastname@example.org our web designer would greatly appreciate the feedback.
